SUMMARY:Public Hearing Local Law #2 Derelict Properties
DESCRIPTION:Introductory Local Law  No. 2 of 2026\nA Local Law to Regulate Derelict Buildings and Create a Derelict Building Registry in the Village of New York Mills.\nBe it Enacted by the Board of Trustees of the Village of New York Mills:\nAuthority\nThis Local Law is enacted pursuant to the Authority granted pursuant to Article 10 of the Municipal Home Rule Law.\nLegislative findings and purpose.\nThe purpose of this Section is to protect the public health\, safety\, and welfare by establishing a registration program for properties demonstrating a pattern of chronic noncompliance with the Village Code. Properties subject to repeated violations impose disproportionate burdens on municipal resources and negatively impact surrounding neighborhoods. This Section provides objective criteria for identifying and monitoring such properties.\nEnactment\nArticle I. Definitions.\nUnless otherwise expressly stated\, the following terms shall\, for the purpose of this Article\, have the meanings indicated in this section:\nENFORCEMENT OFFICER\nThe person so designated by the Mayor\, who is generally the Codes Enforcement Officer for the Village of New York Mills..\nDERELICT PROPERTY\nMeans any parcel of real property that meets the threshold criteria set forth in Article II of this Chapter.\nOWNER\nThose shown to be the owner or owners on the records of the Village of New York Mills Assessor\, those identified as the owner or owners on a vacant building registration form\, a mortgagor in possession\, assignee of rents\, receiver\, executor\, trustee\, lease\, or other person\, firm or corporation in control of the premises. Any such person shall have a joint and several obligations for compliance with the provisions of this article. \nQUALIFYING CODES VIOLATION\nAny violation of any provision of the Village Code or any state fire\, maintenance\, or building code adopted and incorporated therein\, including but not limited to property maintenance\, building\, housing\, fire\, zoning\, or sanitation regulations\, as determined by a Notice of Violation\, as may be issued by the Enforcement Officer\, or service of an accusatory instrument charging any violation of said codes\, including but not limited to the activities set forth above\, issued by an authorized enforcement officer.\nREGISTRATION\nMeans enrollment of a property on the Village’s Derelict Property Registry pursuant to this Article.\nArticle II. Derelict Property.\nA.	Property shall be classified as a Derelict Property and shall be placed on the Derelict Property Registry when:\nThe property has been issued three (3) or more separate Notice of Code Violations within any rolling twelve (12) month period;\nAnd;\nAt least two (2) of the violations remain uncorrected beyond the time allowed for compliance\, or the property demonstrates a recurring pattern of substantially similar Code violations.\nB.	Each Notice of Violation shall be counted separately if it relates to distinct violations or is issued on separate inspection dates. Violations dismissed or vacated by a court of competent jurisdiction shall not count toward the threshold. \nC.	Once deemed a derelict property\, the properly shall be required to be placed on the registry by the Enforcement Officer immediately and said registration will be renewed annually thereafter until the property is no longer out of compliance. \nARTICLE III. Registration Requirements\nA.	Once deemed a derelict property\, the Enforcement Officer shall provide the owner(s) by certified mail a notice with the following information:\n1.	A summary of qualifying violations;\n2.	The effective date of registration;\n3.	Registration requirements and applicable fees;\n4.	Procedures for appeal pursuant to Article VIII.  \nB.	Registration shall take effect fifteen (15) days after mailing unless timely appealed. \nC.	The Owner shall\, within thirty (30) days of registration: \n1.	Submit a completed Derelict Property Registration Form;\n2.	Provide current contact information for the Owner and any managing agent;\n3.	Designate a local responsible party authorized to accept service of process;\n4.	Pay the annual registration fee established under Subsection 2-6-415.\nD.	The person responsible for paying the fee shall be notified of the amount of such cost by first-class mail sent to his/her address as shown on the assessor’s records. The notice shall include a summary of qualifying violations; the effective date of registration; registration requirements and applicable fees; procedures for appeal pursuant to this Subsection. The enforcing officer shall send a copy of the notice to the comptroller\, who shall be responsible for collection of same. If the person responsible fails to pay the total amount due within 30 days after the mailing of said notice\, then a late charge of $10 shall be assessed and added to the charge. If payment of a charge is delinquent as of April 20 following the incurring of the fee\, then the Village Clerk shall cause the charge to be added to the next Village tax bill and collected and enforced in the same manner as provided by law for the collection of taxes by the Village. Prior to adding the charge to the Village tax bill\, there shall be imposed\, an addition to the amount due\, an additional administrative charge in the amount $10.\nE.	Any objection to the fee shall be made within 15 days after the mailing of the notice as provided in Subsection D of this Article III. Such objection shall be in writing and filed with the Village Clerk. The person responsible shall have an opportunity to present objections to the Village Board of Trustees either by personal appearance or in writing and the time to pay same without penalty shall be extended during the pendency of the appeal. The Village Board of Trustees shall determine the merits of the objection and notify the applicant and the comptroller in writing of the determination.\nF.	Failure to register shall constitute a separate and continuing violation of this Code. \nArticle IV. Ongoing Compliance\nProperties on the Registry shall be subject to:\nA.	Periodic inspections as determined by the Enforcement Officer;\nB.	Compliance plans where required;\nC.	Enhanced penalties for subsequent violations.\nD.	Continued failure to correct violations may result in:\n1.	Civil penalties;\n2.	Municipal abatement;\n3.	Recovery of costs through tax lien or special assessment;\n4.	Any other remedies available at law or in equity. \nArticle V. Derelict Property Registration Fees.\nA.	The owner of a property placed on the Derelict Property Registry shall pay an annual fee as set forth below for the period the building remains on the Derelict Property Registry.\nB.	Fee schedule.\n1.	For residential buildings of one to three units:\ni.	For the first year: $500.\nii.	For the second consecutive year: $750.\niii.	For the third consecutive year: $1\,000.\niv.	For each subsequent consecutive year: $1\,500.\n2.	For residential buildings of four to six units\, and mixed commercial and residential buildings of two or three residential units:\ni.	For the first year: $750.\nii.	For the second consecutive year: $1\,000.\niii.	For the third consecutive year: $1\,500.\niv.	For each subsequent consecutive year: $2\,000.\n3.	For residential buildings of seven or more units\, and mixed commercial and residential buildings of four or more units:\ni.	For the first year: $1\,000.\nii.	      For the second consecutive year: $2\,000.\niii.	For the third consecutive year: $3\,000.\niv.	For each subsequent consecutive year: $4\,000.\n4.	For nonresidential buildings:\ni.	For the first year: $1\,000\nii.	For the second consecutive year: $2\,000\niii.	For the third consecutive year: $3\,000\niv.	For each subsequent consecutive year: $4\,000\nC.	For purposes of this Section\, “consecutive year” means uninterrupted placement on the Registry without qualifying removal under Article VII of this chapter.\nD.	The Derelict Property Registry fee shall be the responsibility of the owner of the property and shall be paid by such person. The expense incurred shall be a lien against the real property and shall be assessed and levied as provided in this section.\nArticle VI. Power to repair or abate violations.\nA.	Where an owner or responsible party fails to maintain the derelict property or premises in compliance with any lawful standard\, after notice and opportunity to be heard to such owner or responsible party\, the Village Board of Trustees may cause the violation to be abated\, remedied\, or otherwise corrected and pursue reimbursement for the cost of abatement under any authority available by law\, including\, but not limited to\, Chapter 73 of the Village Code of New York Mills\, New York State Property Maintenance Code 108.2\, or any other equivalent law or ordinance.\nB.	Any owner\, occupant\, or person in charge of the property receiving multiple notices of violation directing the violation to be abated or removed within a rolling twelve-month calendar year shall be subject to an increased percentage of the expenses as set forth below:\n1.	Second notice of violation received: 125%.\n2.	Third notice of violation received: 150%.\n3.	Fourth notice of violation received: 175%.\n4.	Fifth or more notice of violation received: 200%. \nArticle VII. Removal from Registry\nA.	A property may be removed from the Derelict Property Registry upon:\n1.	Demonstrated compliance with all outstanding violations; and\n2.	A twelve (12) month period with no new Code Violations; and\n3.	Payment of all outstanding fees\, fines\, and municipal charges. Removal shall not waive previously incurred penalties.\nArticle VIII. Appeal\nA.	An Owner may appeal placement on the Registry within fifteen (15) days of notice. The Notice of Appeal must be written and filed with the Village Clerk. Appeals shall be heard by the Village Board of Trustees\nThe burden shall be on the Owner to demonstrate that the property does not meet the criteria set forth in Article II.  \nArticle IX. Biannual reports.\nThe Enforcement Officer shall submit a quarterly report not later than January 15 and July 15 of each year to the Village Board of Trustees containing not less than the following information: \nA.	The number of properties in the Village declared derelict under the provisions of this article; and\nB.	The number of derelict property registrations filed or annually renewed with the Enforcement Officer. \nArticle X. Severability.\nThe invalidity or unenforceability of any section\, subsection\, paragraph\, sentence\, clause\, provision\, or phrase of the aforementioned sections\, as declared by the valid judgment of any court of competent jurisdiction to be unconstitutional\, shall not affect the validity or enforceability of any other section\, subsection\, paragraph\, sentence\, clause\, provision\, or phrase\, which shall remain in full force and effect.
